Give a person a hammer, and everything's a nail; give a person a lawmaking ability and suddenly everything's illegal.

Shouldn't the standard legal process of law enforcement (and lawmaking, if necessary) in each jurisdiction cover this?

For the last few decades (at least) government policy/lawmaking has been leaning towards more invasive surveillance of the general public.

To be truly private there would also not be monopolies on lawmaking...

Because it was perceived as an unassailable reason for more lawmaking and regulation, which is what politicians do, even (hypothetically) politicians with the purest motives.

If you read the page you linked closely (and remove all the US specific stuff) you see that it really only talks about of enforcement not lawmaking.

It now seems that bringing up the Constitution as a roadblock to new lawmaking is considered a tired, predictable, and ultimately weak talking point in a debate.

Call it evidence-based lawmaking if you like.

This is why US is not ranked high on any corruption list, while maintaining the highest level if private financial influence not only in the lawmaking but also in national security.

Freedom is not the "liberty for everyone to do what he likes, to live as he pleases, and not to be tied by any laws", but "consists of being under no other lawmaking power except that established by consent".

I foremost think about how the lawmaking process itself could be changed to make it significantly harder to create superficial laws: the type of laws that interfere with consenting people; the type of laws largely responsible for so many prison economies and victimless "crimes." This doesn't answer your question.
