What happens to the judge if the appeals court finds they should have recused? I'm betting the answer isn't "jail time".

Clearly this judge should have recused herself simply to avoid even the appearance of impropriety. Any judge with even a sliver of integrity would have done so.

Assuming the attendee list is public, it should be pretty easy to get the judges attending the "conference" recused from IP related cases from now on.

The irony of this is that Chief Justice Roberts, who seems to specialize in incremental jurisprudence, has recused himself from the case and will not participate in the decision. I believe the half-way argument is weak and will not hold sway.
