In both he'd have been physically prevented from being able to commit suicide. Even if he would have had to suffer even more emotionally through the ordeal, he'd still be alive today.

In this thread alone, I've read people claiming that it's unequivocal fact that Swartz committed suicide because of his prosecution, because his lawyer said so, but that we can't trust a single word out of Ortiz's mouth... because she's a lawyer. We have people claiming, in specific terms, that the US Attorneys as a whole have an interest in encouraging defendant's to commit suicide...

One can view Swartz as completely responsible for his own suicide, while still observing that the overzealous prosecution was a factor that shouldn't have happened regardless of Swartz committing suicide. In other words, the suicide serves to highlight what was already an absurd injustice, and that injustice alone is sufficient to act on.

Be you a lawyer talking privileged to a client, a priest talking privileged to a follower, a hot-line worker talking privileged to someone thinking about suicide, or a social service person talking to a child who been sexually assaulted, every ones communication is equally collected. This is after all the result of ubiquitous surveillance. When people learn about it, the reaction is very simple. people stop talking. They do not call the lawyer. They don't call the priest. The person thinking about suicide won't call the hot-line, and the sexually assaulted child will stay quiet in fear of people finding out.
