Clearly the solution is for Psystar to make a bootloader that takes an OS X DVD as input and results in an install as the output.

PsyStar was trying to confuse this with a host of other items to try to convolute the issue.

Part of me wanted Psystar to win while the other part wanted the entire thing to go away.

If handgun makers aren't liable for murder (or wrongful death), then Psystar shouldn't be liable for copyright infringement.

So according to your logic Apple sued Psystar because Apple was falling behind in the market.

The Psystar imbroglio is a statement of how evil Apple can be about competition these days.

The Psystar folks are inserting a DVD they bought at the Apple Store into their computer and are booting it.

Apple still get the cost of the licence for OS X, so they still get revenue from every PsyStar sold.

Next, Psystar copied Mac OS X from the Mac mini onto a non-Apple computer.

Standard copyright law certainly does not allow Psystar to resell duplicates of Apple's software.

Then the user is infringing, Psystar just sells a program that the user can misuse to install OS X "illegally".

The modified copy became the “master copy” that was used for mass reproduction and installation onto other Psystar computers.

Psystar then modifies this copy of Mac OS X to create a "master copy" that wil run on non-Apple computers.

Psystar then replaced the Mac OS X “bootloader.” The bootloader runs when a computer first comes on and locates and loads portions of the operating system into random access memory.

Psystar doesn't want complete freedom to duplicate and distribute OS X so that's a bit of a strawman.

Psystar also disabled and/or removed Mac OS X kernel extension files and replaced them with other kernel extension files.

Psystar wouldn't be blamed for that, the users would simply think that Apple had made a crash-prone, piece-of-crap OS.
