non-patentability

The patent application linked numerous times in this thread is listed as abandoned after being rejected for non-patentability.

What's more, his patent application was rejected, both for non-patentability, and on similar grounds as a previously rejected patent of a similar nature.

I insist that the fact that the patents still stand is rather an indication of the systemic failure of the court system to enforce the non-patentability of what is ultimately still purely mathematical operations.

But to suggest the non-patentability of software is "just hard to take seriously" is, well, just hard to take seriously, when the largest economy in the world is doing it.

Novelty is novelty, the same tests are used in Germany as in, say, UK because they rely on the European rulings that provided a series of tests to establish that the novelty lies in a suitably technical part of the invention (this born out of interpretation of the non-patentability of "computer programs as such" in Europe).
